HBCU TOUR GIVE-A-WAY

OFFICIAL RULES

 

 

  1. NO PURCHASE NECESSARY: No Purchase necessary to win.  Give-A-Way starts 12:01 am (CST) on January 1, 2008, and ends 11:59 pm (CST) on December 31, 2008 (the “Give-A-Way Period”).  The Tom Joyner Foundation®, Inc. Historically Black College and University (“HBCU”) Tour will be promoted on participating Tom Joyner Morning Show® affiliate stations.

 

2.     ELIGIBILITY: Open to all legal U.S. residents who reside in the forty-eight contiguous United States, excluding residents of  Puerto Rico for the entire Give-A-Way Period, who are high school juniors or seniors.  One (1) parent or legal guardian must accompany the high school junior or senior on the two (2) day HBCU Tour.  Children of employees, volunteers, interns, and agents of the Tom Joyner Foundation®, Inc., The Tom Joyner Morning Show®, Reach Media, Inc., BlackAmericaWeb.com, Inc., and each of their respective parent companies, affiliates, representatives, subsidiaries and advertising and promotion agencies, are ineligible to enter or win.  Void in Puerto Rico and where prohibited by law.  Give-A-Way  subject to all applicable federal, state, local laws and regulations.  By participating, entrants agree to be bound by these Official Rules and accept decisions of the Tom Joyner Foundation®, Inc. and the judges as final in all matters relating to this Give-A-Way.

 

The Tom Joyner Foundation®, Inc., Reach Media, Inc, The Tom Joyner Morning Show®, BlackAmericaWeb.com, Inc. and each of their respective parent companies, subsidiaries, affiliates, representatives, advertising and promotion agencies, and all of their respective employees, officers, directors, shareholders, and agents (collectively  “Releasees”) are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, mistakes, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any website or online service, or any other error or malfunction.  Entry materials that have been tampered with or altered are void. Proof of mailing or faxing entry does not constitute proof of delivery.  Any attempt to deliberately damage the content or operation of this Give-A-Way is unlawful and subject to legal action by the Tom Joyner Foundation®, Inc. or its agents.  Releasees are not responsible for injury or damage to entrants, or to any other persons and/or computers related to or resulting from participating in this Give-A-Way or downloading materials from or use of the website. 

 

  1. HOW TO ENTER: During the Give-A-Way Period, high school juniors or seniors, counselors, parents, or legal guardians must: 1) On a single sheet of 8-1/2” x 11” paper, type or legibly hand-print the high school junior’s or senior’s name, name of parent or legal guardian, address, daytime telephone number, name of high school and counselor, and GPA; and 2) E-mail your information to hbcutours@blackamericaweb.com or fax your information to (972) 789-1428 by no earlier than 12:01 am (CST) on January 7, 2008, and no later than 11:59 pm (CST) on January 11, 2008, for the Elizabeth City State University and Florida A&M University ToursLimit one entry per person per HBCU.  Entries that are incomplete or illegible are void and will not be accepted for entry. All entries become the property of Releasees and will not be acknowledged or returned. 

 

  1. PRIZES/APPROXIMATE RETAIL VALUE (ARV):  Each prize is worth approximately Five Hundred and No/100 Dollars

($500.00).

 

  1. ENTRY PERIOD/JUDGING: There are two (2) HBCU Tours as stated above.  All entries received during the Give-A-Way Period will be judged by the Tom Joyner Foundation®, Inc.  All decisions are final. Winners (which include high school juniors, seniors, parents, and legal guardians) will be notified by telephone or mail. Winners may also be announced during the Tom Joyner Morning Show®. If a Winner cannot attend the HBCU Tour, an alternate may be selected at the discretion of the Tom Joyner Foundation®, Inc.  A total of fifteen (15) high school juniors and/or seniors and a parent or legal guardian for each student will be selected for each HBCU Tour.  Each high school junior and senior will be required to submit documentation from his/her high school which states that the student’s absence from school for two (2) days is approved by the school administration.  Winners will be required to timely execute and return an Affidavit of Eligibility, a Release of Liability, IRS Form W-9, any document required by Releasees, and except where prohibited, a Publicity Release and such other documents requested by Releasees.  Federally issued identification is required for all prizes.  Failure to timely return any requested document will cause prize to be forfeited and awarded to an alternate. If a prize notification letter is returned or deemed undeliverable, an alternate Winner may be selected.  The fair market value of the prize may be considered taxable income to the Winners.  All taxes and other expenses incurred are the Winners’ sole responsibility.  Limit one prize per household.  No substitution, cash equivalent, or transfer of prize permitted.  Releasees will have the right to use the Tom Joyner Foundation®, Inc. HBCU Tour Give-A-Way Winners in all ads, promotions, marketing material, TV, radio, and print ads as it deems appropriate without further consideration, except where prohibited by law.

 

6.     LIMITATIONS:  Releasees are not responsible for any typographical or other errors in printing, the offering or administration of the Give-A-Way, or in the announcement, awarding or acceptance of prizes.  Releasees have no liability whatsoever for any injuries, losses, death, or damages of any kind resulting from acceptance, possession, use or misuse of the prize or participation in this Sweepstakes (including, without limitation, any food and travel related hereto).  All trademarks are used herein for identification purposes only, and are the property of their respective owners.

 

Information supplied by entrants is used only for the purpose of notifying Winners, and will be not be reused, sold or shared in any manner by Releasees without permission.  If you do not wish to receive further contest/promotional information, please direct your request to the Releasees at the address below.

 

  1. CONDITIONS: By participating, entrants (a) agree to these Official Rules and the decisions of the Releasees which shall be final in all respects; (b) release the Tom Joyner Foundation®, Inc., the Tom Joyner Morning Show®, Reach Media, Inc., BlackAmericaWeb.com, Inc., and their respective subsidiaries, affiliates, representatives, and advertising and promotion agencies their respective directors, officers and employees from any and all liability for any injuries, losses or damages of any kind caused by their participation or resulting from acceptance, possession, use, or misuse of the prize; and (c) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to a prize. Noncompliance with the Official Rules will result in disqualification.  By participating, entrants agree to irrevocably assign and transfer all rights, title and interest in and to the entry, including but not limited to, copyrights to the Tom Joyner Foundation®, Inc. Winners are responsible for the payment of taxes on prizes and for any other expenses relating to use of prizes.  Winners consent to the use of their name and/or photograph for promotional purposes, including online announcements, without additional compensation, except where prohibited by law.  Entrants agree that their entry will be owned by the Tom Joyner Foundation®, Inc. and its designees shall have the right to publish, use, adapt, edit and/or modify such entry in any way including in commerce and in any and all media worldwide, including but not limited to the Internet, without limitation and without compensation to the entrant.  Entrants represent that their entries, and the Release’s use thereof, will not infringe upon the rights of any third parties.  Releasees reserve the right to make changes to the Official Rules of the Give-A-Way, including the substitution of a prize or prizes of equivalent or greater value, which will become effective upon written and/or verbal amendment.
