2009 Tom Joyner Family Reunion Talent Show Contest
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES, 21 YEARS OF AGE OR OLDER. VOID IN PUERTO RICO, OVERSEAS MILITARY INSTALLATIONS, OTHER US TERRITORIES AND WHERE PROHIBITED BY LAW.
1. HOW TO ENTER: The 2009 Tom Joyner Family Reunion Talent Show Contest (“Contest”) begins on Monday, June 22, 2009, and ends on Sunday, September 6, 2009 (“Contest Period”), unless terminated earlier or extended at the sole discretion of Sponsor.
The Contest will be conducted in two phases: (i) the Preliminary Competition, which begins on Monday, June 22, 2009, and ends on Sunday, September 6, 2009 and (ii) the Final Competition which occurs on Sunday, September 6, 2009.
In the Preliminary Competition, Participants may enter the Contest by logging onto www.BlackAmericaWeb.com; visiting the Family Reunion micro-site at www.BlackAmericaWeb.com/familyreunion2009; uploading a digital audio or video; and entering their full legal name, e‑mail address, mailing address, and day and evening contact telephone numbers (“required demographic information”). Participants may also enter the Contest by mailing their digital audio or video on CD or DVD, along with required demographic information, to Reach Media, Inc., Attn: TJFR Talent Contest, 13760 Noel Road, Suite 750, Dallas, TX 75240. Participants may enter the Contest as often as they like. All digital submissions must be received no later than Saturday, August 15, 2009. Digital submissions after such date are void.
Submissions, via upload, CD, or DVD, should be in one of the following file formats: video clip (.avi), Windows® Media Audio/Video file (.wmv), or QuickTime® Video Clip (.mov). For video submissions, dimensions should be 648 x 480 pixels. If submitting on CD, media should be CD R. If submitting on DVD, media should be DVD+R, DVD-R, or DVD+/-R. Submissions in other file formats, video dimensions, or media may be accepted at Sponsor’s sole discretion. Submissions may not contain pornographic, obscene, or defamatory material; material that would be objectionable to the Tom Joyner Morning Show or BlackAmericaWeb.com communities; nor be excessive in length of time, nor file size. Mailed media may only contain a single audio or video. Entries not meeting these requirements are void.
Sponsor may accept additional entries, including entries through registration on-site at the Tom Joyner Family Reunion.
From all of the eligible entries (refer to Section 2) received in the Preliminary Competition, Reach shall select up to five (5) entrants and their families (“Finalists”) to participate in an on‑site performance contest (“Final Competition”) to be held at the 2009 Tom Joyner Family Reunion. From the Finalists that compete in the Final Competition, Reach shall award 1st through 5th places in recognition of their performances.
2. Eligibility: Participants must meet the following criteria to be eligible to win the Contest: (i) be a legal U.S. resident of the 50 United States or the District of Columbia; (ii) be at least 21 years of age at time of entry (applies to Entrant only); and (iii) have a guest package to the 2009 Tom Joyner Family Reunion. The following are not eligible to enter: (i) Employees, officers, directors and agents of The Tom Joyner Morning Show®, The Tom Joyner Morning Show® affiliate radio stations, The Tom Joyner Foundation, Inc., Reach Media, Inc., BlackAmericaWeb.com, Inc., Radio One, Inc., (collectively “Sponsor” and/or “Administrator”), and each of their respective parent, subsidiary, affiliated and successor companies, promotion partners, advertising and promotional agencies and (ii) the “immediate family members” and/or “household members” of any of the persons set forth in (i) above (collectively the “Contest Entities”). Immediate family members shall mean parents, step-parents, children, step-children, siblings or spouses. Household members shall mean people who share the same residence at least three months a year. Individuals who have won any other prize from Reach Media, Inc., any contest aired on the Tom Joyner Morning Show®, or any other of their contests, promotions or giveaways in the previous sixty (60) days are also not eligible to enter or win. Contest is void where prohibited by law and is subject to all federal, state and local laws and regulations. By participating, participants agree to abide by these Official Rules and the decisions of Sponsor, which are final and binding in all respects.
3. Eligibility Determination. Prize will be awarded to a Winner only after eligibility has been determined. This shall include, but not be limited to, such potential Winner satisfying all of the elements of registration as provided for in the Official Rules. The Sponsor’s determination shall be deemed final. In addition, such potential Winner shall have fulfilled all of the prize conditions and accurately completed the documentation required herein, including as specifically set forth in Section 6 of these Official Rules.
4. PRIzes & Selection of Winner. Decisions of the Sponsor with respect to the Contest are final. Any change in the duration of the Contest will be listed on www.BlackAmericaWeb.com 5. PRIZES. 1st through 5th place prizes will be award in recognition of the Finalists’ performances. Prizes have no retail value. Odds of winning depend on the number of eligible entries received. 6. GENERAL PRIZE CONDITIONS. By participating, participants agree to abide by these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Only one (1) prize per family during the Contest Period. Any prize won by the same individual, or by different individuals in the same household or family, beyond the first will be forfeited. For purposes of the Contest, “household” shall be defined as persons living at the same street address, either full or part time, whether or not such individuals are legally related or not. Awarded prizes are only as detailed above, are not transferable or assignable and cannot be redeemed for cash. Sponsor may, in its sole discretion, but is under no obligation to, substitute a prize of comparable or greater value. If a selected Finalist does not respond to notification e-mail within three (3) days of its transmission, or should an e‑mail, after up to three (3) attempts, be returned as undeliverable, the potential Finalist will be disqualified and an alternate Finalist will be selected, time permitting.
7. RELEASES. All participants, by participating in the Contest, agree that Contest Entities and each of their respective officers, directors, employees, independent contractors, salespeople, representatives and agents (collectively, the “Releasees”) are released from all liability whatsoever, and will be held harmless by participant, from and against any and all claims, actions and/or liability for injuries, losses or damages of any kind to person, including without limitation, death and property, resulting in whole or in part, directly or indirectly from the acceptance, possession, use or misuse of the prize, participation in a Contest-related activity, or participation in the Contest. Participants acknowledge that Sponsor has neither made, nor is in any manner responsible for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Contest. Prior to receiving a prize, participants must sign an official release form provided by Sponsor.
8. USE OF NAME/LIKENESS. By entering this Contest or accepting a prize, all participants consent, where lawful, to the use of their name, portrait, picture or other likenesses, hometown, state of origin, and/or voice in any and all media now or hereafter known (including on The Tom Joyner Morning Show®, affiliate radio stations, affiliated web sites, Facebook.com, Twitter, etc.) for publicity, advertising and promotional purposes worldwide in perpetuity without additional compensation, notification or permission and without the right of review. By participating in the Contest, where allowed by law, participants agree that Sponsor may disclose personal information obtained from participants in Contest to affiliated entities and use this information for marketing and other purposes, though no personal information will be sold. By entering the contest, Entrants acknowledge that they are solely responsible for their submissions and represent that they own or have the necessary licenses, rights, consents, and permissions to use and authorize Sponsor to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all submissions to enable inclusion and use of the submissions in the manner contemplated by the Contest.
9. LIMITATIONS OF LIABILITY. Sponsor assumes no responsibility and disclaims all liability for any lost, late, incomplete, inaccurate, stolen, misdirected, delayed, mis-delivered or undelivered items sent by electronic transmission or other delivery method. Releasees are not responsible for any incorrect or inaccurate entry information, whether caused by any of the equipment associated with or utilized in the Contest, and Releasees assume no responsibility for any error, omission, interruption, defect, failure, malfunction or delay in operation or transmission, or for any damage to participant’s or any third party’s computer, hardware, software, or any other device, or for theft or destruction, tampering, or unauthorized access to entry information, or for entries which are late, delayed, misdirected, inaccurate, incomplete or, inaudible, disconnected (or any combination thereof) or for preemption or cancellation of radio program, or for technical, network, typographical, human or other errors or problems relating to or in connection with the Contest, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the announcement of prizes or in any Contest-related materials. If, for any reason, the Contest is not capable of running as planned by reason of tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest (or any portion thereof). Any attempt to defraud Sponsor in any way will result in disqualification of participant, and such participant will be prosecuted to the fullest extent of the law. IN NO EVENT WILL RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ANY PARTICIPANT'S PARTICIPATION IN THE CONTEST.
10. ADDITIONAL RULES AND RESTRICTIONS. Sponsor reserves the right to make changes in the rules of the Contest in its sole discretion at any time without notice, which will become effective immediately. In the event any Winner is found to be in violation of these Official Rules or is otherwise determined by Sponsor, in its sole discretion to be ineligible, he/she will be required to forfeit prize.

12. WINNERS LIST: The name of the winners will be posted between after September 14, 2009, on www.BlackAmericaWeb.com or send a self-addressed, stamped, envelope to Sponsor at: 2009 Tom Joyner Family Reunion Talent Show Contest Winners, c/o Reach Media, Inc., 13760 Noel Road, Suite 750, Dallas, TX 75240.
